Terms of Service

1. Acceptance

By accessing or using Sotenbori (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Sotenbori is a communication skills training platform that uses AI personas to simulate difficult workplace conversations and score your performance. It is also available to organizations for structured hiring assessments.

3. Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is accurate.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to reverse-engineer, scrape, or automate access to the Service beyond normal use
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to circumvent any security, access control, or rate-limiting measures
• Use assessment features for hiring decisions that violate applicable employment discrimination laws

6. Subscriptions and Billing

Some features of the Service require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Subscriptions renew automatically at the end of each billing period
• You may cancel at any time; cancellation takes effect at the end of your current billing period
• We do not provide refunds for partial billing periods
• We may change subscription prices with at least 30 days' notice

All payments are processed by Stripe. Your payment information is subject to Stripe's privacy policy.

7. Intellectual Property

The Service, including its software, design, and content (excluding your data), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

Your conversation transcripts and session data remain yours. By using the Service, you grant us a limited, non-exclusive license to process your data solely to provide the Service.

8. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure, or that AI scoring will be accurate or suitable for any particular purpose. Your use of the service is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service, with or without notice. You may delete your account at any time via the Settings page. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We may update these Terms from time to time. We will notify you by email of any material changes. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
